Terms of Service
Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Sendsentry website and services, including any content, functionality, and features offered on or through our platform (collectively, the “Service”). By accessing or using Sendsentry, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use the Service.
Overview: Sendsentry (operated by IT Global Services, LLC) provides tools and services for email infrastructure auditing, continuous monitoring of email deliverability and security, email validation, and related features designed to improve sender reputation and email
performance. Our users include individuals and businesses seeking to optimize their email systems. The following Terms outline the rules and obligations of using Sendsentry, as well as disclaimers and limitations of our liabilities to you.
Definitions
For clarity in these Terms, we define certain capitalized terms as follows:
• “Sendsentry,” “Company,” “we,” “us,” or “our” – refers to IT Global Services, LLC, doing business as Sendsentry, including our owners, officers, directors, employees, contractors, and agents. Sendsentry is the provider of the Service.
• “Service” – means the Sendsentry online platform, website, and all services, tools, and features provided by Sendsentry, including but not limited to email infrastructure audit services, deliverability monitoring, email validation tools (credit- based or otherwise), analytics dashboards, alerts, reports, and any other products or services offered via our site or applications.
• “User” or “you” – refers to any person or entity who accesses or uses the Service, whether by browsing the website, creating an account, or using any of our tools. This includes both free (unregistered) visitors and registered customers (whether on a free trial, free tier, or paid subscription).
• “Account” – refers to the registered account you create on Sendsentry to access certain features of the Service. An Account may be created via traditional sign-up (email/password) or via OAuth through an authorized third-party platform. Each Account is associated with a single user or legal entity.
• “Content” – means all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials accessible via the Service. This includes content provided by us (such as the text on our website, images, software, and reports we generate) as well as content that you, the user, input or upload (such as domain information for audits, email addresses for validation, or configuration details you provide). User-provided content is also
referred to as “User Data.”
• “Third-Party Services” – refers to any third-party websites, services, or products that may be integrated with or used by Sendsentry in delivering the Service (for example, Stripe for payments or Google for OAuth login and analytics).
• “Subscription” or “Plan” – refers to a paid service plan for ongoing Sendsentry services (such as monthly or annual monitoring plans, or recurring purchases of
email validation credits). A Subscription is typically billed on a periodic basis (e.g., monthly or yearly) and renews automatically unless canceled.
• “Consumable Products” – refers to items or credits that are used as they are consumed, such as email validation credit packages. These are typically deducted from your balance as you use the service (for example, each email validation may consume one credit from a purchased bundle).
These definitions are provided for convenience and clarity. They apply throughout these Terms, and any term not defined here will have its plain English meaning in the context it is used. In case of any ambiguity in interpretation, these Terms will be construed without strict draftsmanship in favor of either party.
Acceptance of Terms
By accessing or using any part of the Service, you confirm that you accept these Terms and agree to comply with them. If you are using Sendsentry on behalf of a company or other legal entity (for example, as an employee or contractor of a business), you represent and warrant that you have the authority to bind that entity to these Terms, in which case “you” shall refer to the entity. If you do not have such authority, or if you do not agree with these
Terms, you must not use the Service.
You understand that these Terms, together with our Privacy Policy (which is incorporated herein by reference), form a binding legal agreement between you and Sendsentry. Additional terms may apply to specific features or offerings (for example, if we offer a promotional free trial or beta features, we may provide additional terms for those). In the event of a conflict between these Terms and any additional terms for a specific feature, the additional terms will govern for that feature to the extent of the conflict.
User Accounts and Registration
To access many features of Sendsentry, you must create a User Account. The following terms apply to account registration and maintenance:
• Account Information: When you register for an account, you agree to provide true, accurate, current, and complete information about yourself (or your organization, if applicable) as prompted by our registration form. You also agree to update such information promptly to keep it accurate and current. We are not responsible for any communication or service issues arising from outdated or incorrect account information provided by you.
• Account Credentials: If you create an account with an email and password, you must choose a secure password. You are responsible for maintaining the confidentiality of your password and any credentials used to access your account. If you register via an OAuth provider (like Google Sign-In), you will authenticate through that provider and abide by their authentication rules; you are still responsible for any actions taken through your Sendsentry account connected to that login.
• Unauthorized Access: You must notify us immediately at support@Sendsentry.com if you suspect or become aware of any unauthorized access to or use of your account or any security breach. We are not liable for any loss or damage arising from your failure to keep your account credentials confidential. You may be held liable for losses incurred by us or others due to such unauthorized use.
• Multiple Accounts: You may not create multiple accounts for the purpose of abusing our services or bypassing restrictions. Each user or organization should
maintain only one account unless expressly permitted by us (for example, you might have one personal account and one separate business account).
• Account Eligibility: We do not impose specific age or geographic restrictions for account creation (we welcome users globally). However, by creating an account, you represent that you are at least the age of legal majority in your jurisdiction (or have parental/guardian consent if you are a minor but above the age of 13). As noted in our Privacy Policy, our Service is not intended for children under 13. If you are under 13, you are not permitted to create an account or use the Service.
• Account Termination: You may close your account at any time by contacting us or using available account deletion tools (if provided). Please note that residual data may remain in our backups or logs for a period as outlined in our Privacy Policy. We reserve the right to suspend or terminate your account as described under Termination below.
By using Sendsentry, you agree to use the Service responsibly and abide by all applicable laws and these Terms. In particular, you agree not to engage in any of the following prohibited activities:
Violating Laws or Regulations: You will not use the Service in any manner that violates any applicable law or regulation. This includes (but is not limited to) all data protection and anti-spam laws. For example, if you use Sendsentry’s email validation or monitoring tools, you must ensure that you are legally permitted to use and process the email addresses or domains you enter (e.g., that you have obtained
email contact lists in compliance with laws like CAN-SPAM, GDPR, or other anti- spam/privacy regulations).
• Unauthorized Access and Security Violations: You will not attempt to gain unauthorized access to any portion of the Service or any related systems or networks. This means you must not hack, scan, or test the vulnerability of our infrastructure without authorization. Additionally, you shall not decrypt, decompile, or reverse engineer the software or Service (except to the extent such activities are expressly permitted by law notwithstanding this prohibition).
• Interference with the Service: You will not interfere with or disrupt the integrity or performance of the Service. This includes not engaging in activities like introducing viruses, worms, Trojan horses, malware, or any other destructive code; not launching any form of denial-of-service (DoS) attack; and not using any automated system (like scripts or bots) to send more request messages to the Service than a human could reasonably produce in the same time.
• Improper Use of Features: You will use our tools and features only for their intended purposes. For example, our email validation service should be used to
clean and verify email lists that you own or have rights to use for lawful communication. You must not use Sendsentry’s services to verify or scrape email addresses that you have obtained improperly or to assist in sending unsolicited mass emails (“spam”). Likewise, you should only monitor domains or email systems that you own or are authorized to manage. Misuse of our features for illicit or unauthorized purposes is strictly prohibited.
• Intellectual Property Violations: You will not copy, reproduce, distribute, republish, or create derivative works based on any part of the Service or its Content (other than your own User Data) without our prior written consent. This also means you won’t remove or obscure any copyright, trademark, or other proprietary notices on the Site or reports.
• Impersonation and Misrepresentation: You shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity or affiliation with a person or entity while using the Service. For instance, you cannot create an account using someone else’s name or a fake identity, and you should not mislead others as to who is performing an audit or posting any content.
• Harassment or Illegal Conduct: You will not use the Service to harass, abuse, or harm others, nor to post or transmit any content that is unlawful, defamatory,
libelous, threatening, pornographic, obscene, or otherwise objectionable. Any content submitted through the Service must comply with all applicable content standards (if we provide forums or community features, those will have their own guidelines you must follow).
• Automated Queries: Except as may be expressly permitted by Sendsentry (for example, through an API with a separate agreement), you will not use any automated system to access the Service in a manner that sends more requests to our servers than a human can reasonably produce in the same period. Scraping, crawling, or caching content from the Service without permission is prohibited, except for publicly accessible content for the sole purpose of search engine indexing (and in accordance with our robots.txt file).
User Responsibilities: You are responsible for all of your activity in connection with the Service and for all User Data that you submit or upload. You represent and warrant that you have all rights and permissions necessary to submit your User Data to the Service and to utilize it (and any results from the Service) as contemplated by these Terms. Sendsentry is not responsible for the accuracy, quality, integrity, legality, or reliability of any User Data you provide or of the results obtained by using our Service on your data (for example, we provide analysis and recommendations, but it’s your responsibility to review them and
decide on actions). If you violate the above acceptable use provisions or any other aspect of these Terms, we may take action including removing or disabling access to your content, suspending or terminating your account, and, if necessary, reporting you to law enforcement authorities. We reserve the right to investigate any violation of these Terms or misuse of the Service.
Payments, Subscriptions, and Refunds
Certain Sendsentry services are provided for a fee, such as premium audits, monitoring subscriptions, and email validation credit packages. The following terms apply to fees, billing, and refunds:
Fees and Pricing: The fees for our services are as set forth on our website (for example, on our Pricing page) or as otherwise communicated to you in writing. We may offer various plans including one-time services (e.g., a one-time Email Audit package) and recurring subscription plans (e.g., monthly or annual monitoring plans, or monthly credit bundles). All prices are listed in U.S. Dollars (unless otherwise specified) and are subject to change. We reserve the right to modify our pricing or introduce new fees with prior notice to you (price changes will not apply retroactively to services already purchased, but they would apply upon renewal of a subscription).
• Taxes: Our fees do not include any applicable sales, use, value-added, or similar taxes. You are responsible for any taxes or duties payable on the services provided to you (other than taxes on our income). If we are required to collect taxes from you, we will add such taxes to the fees and charge or invoice you accordingly.
• Billing and Payment: By purchasing a paid Service (including signing up for a subscription or buying credits), you authorize us to charge your chosen payment method (such as a credit card) through our secure payment processor (e.g., Stripe) for the applicable fees. For subscriptions, you agree that we may charge your payment method automatically on a recurring basis (monthly or annually, depending on your plan) without further action by you, until you cancel the subscription. If any payment is not successfully settled (due to expiration, insufficient funds, or otherwise) and you do not cancel the account, we may suspend your access to the paid features until payment is received. You must provide current, complete, and accurate billing information. If your card expires or billing info changes, you should promptly update your account or it may result in interruption of service.
• Auto-Renewal: Subscriptions will automatically renew at the end of each billing cycle (e.g., at the end of each month for monthly plans, or each year for annual plans) unless you cancel the subscription before the renewal date. By default, the renewal will be for the same duration and at the then-current price of your plan, unless otherwise stated at the time of original purchase. We will charge your designated payment method on the renewal date for the subscription fee and any applicable taxes. If you do not wish for a subscription to renew, you must cancel it in your account settings or by contacting support prior to the renewal date. Please note that if you cancel a subscription, you will typically continue to have access to the paid Service until the end of the current billing period, and no further charges will be made, but you will not receive a refund for the remaining period except as stated otherwise.
Refund Policy: We want you to be satisfied with our services. Our refund policy is as follows:
Chargebacks and Payment Disputes: If you dispute a charge with your bank or credit card company, and the dispute is resolved in our favor (meaning the charge was valid under these Terms), you may be responsible for any resulting fees incurred by us, and we reserve the right to terminate your account for fraudulent chargeback behavior. If you have an issue with a charge, we encourage you to contact our support first to resolve the matter quickly.
Promotions and Free Trials: We may occasionally offer promotional discounts, coupons, or free trial periods for certain services. Such promotions are subject to these Terms as well as any additional terms that accompany the offer. Free trials provide temporary access to the Service for evaluation; if you do not cancel by the end of the trial, you may be charged for continued use as per the terms of the trial offer. Eligibility for promotional offers may be limited and we reserve the right to modify or withdraw any promotion at any time.
All fees are charged and payable in the manner described at the time of purchase. If you have any questions about billing or believe there has been an error in billing, please contact support@Sendsentry.com promptly so we can review and correct any issue.
